General Conditions of Sale

Preamble

These General Conditions of Sale are concluded between, on the one hand, VIBED and on the other hand, Internet users who wish to place an order (hereinafter the “Customer”) on the VIBED website.
The Customer means any natural person making a purchase on the Site.
The Client must be:
- either a natural person aged over 18 and having full legal capacity to contract;
- either a natural person aged under 18 and emancipated;

The Site designates the portal www.vibed.store and/or any other address that VIBED may substitute or add to it.

An Order: request for one or more products made by a Customer to VIBED under the conditions set out in these General Terms and Conditions.
The Products: this term designates the products marketed by VIBED and offered for sale on the Site.
These General Terms and Conditions govern the sale of all products presented on the VIBED Site.

The parties agree that their relations will be exclusively governed by these General Terms and Conditions, to the exclusion of any other condition.

VIBED reserves the right to adapt or modify these conditions at any time. In the event of modification, the conditions in force on the day of the Order will be applied to each Order. If a condition were to be missing, it would be considered to be governed by the practices in force in the distance selling sector, in accordance with French law, which alone will be applicable.

Any order placed on the Site implies full acceptance, without reservations or conditions, of the General Terms and Conditions in force on the day of said order.

Article 1 - Company

VIBED is a brand of the simplified joint stock company Vere primo flore with capital of €40,000, whose head office is located in Paris 17, France and registered in the Paris Trade and Companies Register under number RCS 878260553.

Article 2 - Purpose

These General Terms and Conditions define the rights and obligations of the Parties as well as all the terms of sale, in particular the order, payment, delivery between VIBED and the Customer.

Article 3 - Products and Availability

VIBED offers ready-to-wear products and accessories for sale.
VIBED guarantees the authenticity of the products offered for sale. Product offers and prices are valid as long as they are visible on the Site, and until stocks run out.
VIBED does not guarantee in any way that the products will be kept on sale for a specific period. VIBED undertakes to notify by email or telephone any Customer who has placed an Order for an unavailable product. In no way can the Customer hold VIBED liable in the event that he has validated the Order for an unavailable product. In the event of a debit of the amount of an Order relating to an unavailable product, VIBED undertakes within 10 days, depending on the Customer's choice, either to reimburse the Customer or to issue him a credit for the amount of his Order.
In the event of a stock shortage of one of the Products in an Order comprising several Products, VIBED will ship the remainder of the Order.
The products offered for sale are presented and detailed with the greatest possible precision.

Article 4 - Order and Payment Terms

The Customer who wishes to purchase one or more Products on the website www.vibed.store must comply with the following process:
- The Customer selects the Product(s) he/she wishes to purchase by clicking on the “Add to cart” icon:
- The Customer, after having checked his selection (color, size, price, etc.) validates the choice of the selected product(s) by clicking on the “Order” icon;
The Customer must then:
- If he is already a VIBED Customer : fill out the form by indicating only his email address and password
- If you are a new VIBED customer: fill out the form with your first name, last name, contact details and email address.
He then has the option to order as a "guest" without creating a customer account or to validate the creation of a customer account by entering a password.
The shipping costs of the Order are then indicated to the Customer.
The Customer then accesses a payment page summarizing their order.
The Customer can pay by different means of payment that will be offered to him. When the Order is finalized, VIBED confirms the Order to the Customer by sending him a summary email.

Article 5 - Prices

The prices of the Products are displayed in euros. VAT is included in the price displayed at the rate in force in France for the products concerned.
The shipping costs for the Customer's Order will be indicated to the Customer before its final validation.

Article 6 - Right to Return Items

In accordance with the provisions of Article L121-20-12 of the Consumer Code, the individual Customer has a period of 100 calendar days from receipt of the Product(s) ordered to exercise his right of withdrawal from VIBED , without having to provide reasons or pay a penalty.
In the event of exercising the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and the shipping costs will be reimbursed, at the latest fourteen (14) days following the date on which the right was exercised.

The Products must be returned in their original condition and complete (tried but not worn) in packaging identical to that used during shipping.

The Customer can only exercise his right of return once per order, with the exception of a shipping error attributable to VIBED. 

Article 7 - Limitation of Liability

VIBED is subject to an obligation of means towards the Customer. It is expressly agreed that any disruption in the provision of the service for any reason whatsoever, any external intrusion or infection by a computer virus, cannot engage the responsibility of VIBED provided that it is attributable to the consumer or to the actions of a third party. Furthermore, the Site cannot be held responsible for the non-performance of a contract concluded, due to the occurrence of a force majeure event and in particular in the event of a total or partial strike of postal services, carriers, and disasters caused by floods or fires.
In the event of dissatisfaction of a Customer for any reason whatsoever, he/she will not be able to claim any compensation other than that of a value equivalent to the product(s) purchased.

Article 8 - Personal Data and Protection of Privacy

In accordance with Law No. 78-17 of January 6, 1978 "Informatique et Libertés", the Customer has the right to access, rectify and delete data concerning him recorded by www.vibed.store. The Customer may contact VIBED at any time and oppose the commercial use of his personal data recorded by VIBED To do this, simply send a message via the contact page of the site.

Article 9 - Intellectual Property

All elements of the Site, whatever they may be, are protected by copyright, trademarks and patents. They are the exclusive property of VIBED . The reproduction of all or part of VIBED and/or the Site constitutes an infringement within the meaning of the Intellectual Property Code.

Article 10 - Force Majeure

VIBED will not be liable for the non-performance of its obligations in the event of the occurrence of a case of force majeure, defined as any unforeseeable, irresistible event resulting from external circumstances, making the performance of the Contract impossible, in particular a partial or total carrier strike or a natural disaster.

Article 11 - Law - Disputes

The General Terms and Conditions in French shall be executed and interpreted in accordance with French law. The Customer, by accepting these terms and conditions, irrevocably grants exclusive jurisdiction to the French courts.
In the event of a dispute, the Customer shall contact VIBED as a priority to obtain an amicable solution. Failing this, the competent court in the event of a dispute shall be that of the place of domicile of the defendant or, at the plaintiff's choice, the place of actual delivery of the product.
